These Terms of Use (“Terms”) are a binding agreement between you and Aptiva Health, LLC (“Aptiva,” “we,” “us,” or “our”) and govern your access to and use of the Aptiva Learning Hub website at learn.aptivahealth.com and any related pages, content, tools, the “Ask Aptiva” assistant, and community features (together, the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. About the Hub
The Aptiva Learning Hub is a free, public healthcare-literacy and education resource. It is the educational companion to Aptiva Health and is intended to help people understand conditions, treatments, how health insurance works, cash-pay options, and how to lower the cost of care. The Site is not a patient portal, does not provide clinical services, and does not facilitate appointments, payments, or purchases.
2. Not Medical, Legal, Financial, or Insurance Advice
The Site is for general education only. Its content — including articles, courses, the glossary, community discussions, and responses from the “Ask Aptiva” assistant — is not medical, legal, financial, tax, or insurance-coverage advice, and is not a substitute for advice from a qualified professional.
- Always consult a qualified clinician about your own diagnosis, treatment, or care.
- Verify any coverage, cost, or benefit information with your insurer or provider; specifics vary by plan.
- Reading the Site does not create a doctor–patient, attorney–client, or advisory relationship.
- In a medical emergency, call 911 or go to the nearest emergency department. Do not rely on the Site for emergency or time-sensitive needs.
3. No Protected Health Information (PHI)
The Site is not designed to collect protected health information, and you must not submit personal health, medical, or identifying details through any form, the community, or the “Ask Aptiva” assistant. Keeping the Site free of PHI helps it remain outside the scope of HIPAA. If you share such information, you do so at your own risk, and you grant us the right to remove it.
4. Ownership of the Site
The Site, and all text, graphics, illustrations, logos, software, and other content we provide (excluding User Content and third-party materials), are owned by or licensed to Aptiva and are protected by copyright, trademark, and other laws. Except as expressly permitted, nothing in these Terms transfers any ownership or intellectual-property rights to you.
5. License to Use the Site
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial, educational purposes. You may not copy, reproduce, republish, scrape, sell, or distribute Site content except as permitted by the “Cite or embed” features we provide or with our prior written consent.
6. Accounts and Access
Some features (such as saving course progress or participating in the community) may require an account. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity under your account. We may suspend or terminate access at our discretion, including for conduct that violates these Terms. We may modify, suspend, or discontinue any part of the Site at any time.
7. Acceptable Use
Community participation is also governed by our Community Guidelines.
You agree not to:
- Use the Site for any unlawful, harmful, or fraudulent purpose;
- Submit any protected health information or other sensitive personal data;
- Post harassment, hate speech, threats, discrimination, spam, solicitation, or advertising;
- Present individualized medical, legal, or insurance advice to others as fact;
- Impersonate any person or misrepresent your affiliation;
- Attempt to access, scrape, disrupt, reverse-engineer, or interfere with the Site, its security, or its underlying systems;
- Upload malware or any code intended to harm or overload the Site.
8. Community and User Content
The community is peer support, not medical advice. If you post, comment, or otherwise submit content (“User Content”), you are solely responsible for it, and you represent that you have the right to share it and that it complies with these Terms.
You grant Aptiva a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, display, reproduce, and adapt your User Content for the purpose of operating, moderating, and promoting the Site. We may, but are not obligated to, review, moderate, edit, or remove any User Content at our discretion, including content that contains PHI, is unlawful, or violates these Terms. We are not responsible for User Content and do not endorse any opinions expressed by users.
9. The “Ask Aptiva” Assistant
“Ask Aptiva” is an automated assistant that answers questions using published Site content. It is provided for general education only, may be incomplete or inaccurate, does not provide individualized medical, legal, financial, or emergency advice, and is not a substitute for a qualified professional. Do not submit PHI to the assistant. Queries may be logged on an anonymous basis to improve our educational content, as described in our Privacy Policy.
10. Third-Party Links and Aptiva Health
The Site may link to third-party websites and to Aptiva Health (aptivahealth.com), which are governed by their own terms and privacy practices. We do not control and are not responsible for third-party sites, services, or content, and a link does not imply endorsement.
11. Intellectual Property; Copyright Complaints (DMCA)
“Aptiva,” “Aptiva Health,” “Aptiva Learning Hub,” and related names and logos are trademarks of Aptiva or its affiliates and may not be used without permission. If you believe content on the Site infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512) to the contact in Section 21. We may remove allegedly infringing material and terminate repeat infringers.
12. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty that the Site will be uninterrupted, secure, or error-free. We do not warrant that any educational, insurance, or cost information is current, complete, or applicable to your situation.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, APTIVA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification and Release
You agree to indemnify, defend, and hold harmless Aptiva and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your User Content, or your violation of these Terms or of any law or third-party right.
15. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
16. Electronic Communications
By using the Site or providing your email, you consent to receive communications from us electronically, and you agree that electronic notices, agreements, and disclosures satisfy any legal requirement that such communications be in writing.
17. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last revised” date and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
18. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, outages, network or hosting failures, labor disputes, or governmental actions.
19. Governing Law
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.
20. Dispute Resolution; Arbitration; Jury Waiver
Please read this section carefully — it affects your legal rights. Except for claims that qualify for small-claims court and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Site will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable rules. Any in-court proceeding permitted under this section will take place in Jefferson County, Kentucky (or the U.S. District Court for the Western District of Kentucky). You and Aptiva waive any right to a jury trial and agree that claims will be brought only in an individual capacity and not as part of a class action.
21. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms, in whole or in part, without restriction.
22. Entire Agreement; Severability
These Terms and the Privacy Policy are the entire agreement between you and Aptiva regarding the Site and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary.
